General Provisions<\/strong><\/h2>\n<p>1.1. Limited Liability Company &quot;Food Technology&quot; (TIN 7714895127), represented by General Director Komarova Galina Grigoryevna, acting on the basis of the Charter, hereinafter referred to as the &quot;Seller&quot;, publishes a Public offer for the sale of goods based on the samples presented on the official website of the Seller <a href=\"https:\/\/sakura-restaurant.ru\/en\/\">https:\/\/sakura-restaurant.ru<\/a>.<\/p>\n<p>1.2. In accordance with Article 437 of the Civil Code of the Russian Federation, this document is a public offer, and if the conditions set out below are accepted, the individual accepting this offer pays for the Seller&#039;s Goods in accordance with the terms of this Agreement. In accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, payment for the Goods by the Buyer is an acceptance of the offer, which is considered equivalent to the conclusion of the Agreement on the conditions set forth in the offer.<\/p>\n<p>1.3. Based on the foregoing, carefully read the text of the public offer, and if you do not agree with any clause of the offer, you are invited to refuse to purchase the Goods or use the Services provided by the Seller.<\/p>\n<p>1.4. In this offer, unless the context otherwise requires, the following terms have the following meanings:<\/p>\n<p><strong>&quot;Offer&quot;<\/strong> \u2013 the Seller\u2019s public offer addressed to any individual (citizen) to conclude a sales contract (hereinafter referred to as the \u201cAgreement\u201d) with him on the existing terms and conditions contained in the Agreement, including all its annexes;<\/p>\n<p><strong>&quot;Operator&quot;<\/strong> - an employee who takes orders by phone;<\/p>\n<p><strong>&quot;Buyer&quot;<\/strong> \u2013 an individual who has entered into an Agreement with the Seller on the terms and conditions contained in the Agreement;<\/p>\n<p><strong>&quot;Acceptance&quot;<\/strong> - full and unconditional acceptance by the Buyer of the terms of the Agreement;<\/p>\n<p><strong>&quot;Product&quot;<\/strong> - a list of assortment items presented on the official website;<\/p>\n<p><strong>&quot;Order&quot;<\/strong> - individual items from the assortment list of the Goods specified by the Buyer when placing an order on the website or by phone.<\/p>\n<p><strong>&quot;Delivery&quot;<\/strong> \u2013 courier services for the delivery of the Order.<\/p>\n<p>&nbsp;<\/p>\n<p><!-- \/wp:post-content --><\/p>\n<p><!-- wp:heading --><\/p>\n<p><!-- \/wp:heading --><\/p>\n<h2><!-- wp:paragraph --><strong>2. Subject of the contract<\/strong><\/h2>\n<p>2.1. The Seller sells the Goods in accordance with the current price list \/ assortment published on the Seller&#039;s website <a href=\"https:\/\/sakura-restaurant.ru\/en\/\">https:\/\/sakura-restaurant.ru<\/a>, and the Buyer makes payment and accepts the Goods in accordance with the terms of this Agreement.<\/p>\n<p>2.2. This Agreement and its appendices are official documents of the Seller and an integral part of the offer.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>3. Placing an order<\/strong><\/h2>\n<p>3.1. The order of the Goods is carried out by the Buyer daily from 11-00 to 23-30 through the Internet site <a href=\"https:\/\/sakura-restaurant.ru\/en\/\">https:\/\/sakura-restaurant.ru<\/a> or by phone +7 (499) 254-08-05. You can place an order at a convenient time for you, or in the near future.<\/p>\n<p>3.2. The buyer gets acquainted with the Goods according to the photo-samples and description presented on the website <a href=\"https:\/\/sakura-restaurant.ru\/en\/\">https:\/\/sakura-restaurant.ru<\/a>. All information materials presented on the site are for reference only and cannot fully convey reliable information about certain properties and characteristics of the Goods. If the Buyer has any questions regarding the properties and characteristics of the Goods, before placing the Order, he must seek advice from the Operator.<\/p>\n<p>3.3. When registering on the Seller&#039;s website, the Buyer undertakes to provide the following registration information about himself:<\/p>\n<ul>\n<li>last name, first name,<\/li>\n<li>actual delivery address;<\/li>\n<li>E-mail address;<\/li>\n<li>contact phone (mobile, landline).<\/li>\n<\/ul>\n<p>3.4. When placing an Order through the Operator, the Buyer undertakes to provide the information specified in clause 3.3. actual agreement.<\/p>\n<p>3.5. The Seller undertakes not to disclose the Buyer&#039;s data specified during registration on the site and when placing the Order to persons not related to the execution of the Order.<\/p>\n<p>3.6. The Seller and the Operator are not responsible for the content and accuracy of the information provided by the Buyer when placing the Order.<\/p>\n<p>3.7. The Buyer is responsible for the accuracy of the information provided when placing the Order.<\/p>\n<p>3.8. The prices for any item of the Goods indicated on the Seller&#039;s website may be changed by the Seller unilaterally without obligatory notification of the Buyer. In the event of a change in the price of the Goods that have already been ordered by the Buyer, the Operator informs the Buyer about this as soon as possible in order to receive confirmation or cancel the order.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>4. Terms of execution of the Order<\/strong><\/h2>\n<p>4.1. The term of execution of the Order depends on the availability of the ordered items of the Goods from the Seller and the time required to process the Order. The deadline for the execution of the Order in exceptional cases may be agreed with the Buyer individually, depending on the characteristics and quantity of the ordered Goods. In the absence of a part of the Order in the warehouse of the Seller, including for reasons beyond the control of the latter, the Seller has the right to cancel the specified Goods from the Buyer&#039;s Order. The Seller undertakes to notify the Buyer about the change in the completeness of his Order through the Operator.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>5. Payment for the Order<\/strong><\/h2>\n<p>5.1. Funds are accepted in two ways: cash, non-cash payment. The Buyer&#039;s obligation to pay for the cost of the Goods is considered fulfilled from the moment the Seller actually receives the funds from the Buyer.<\/p>\n<p>5.2. The Buyer pays for the Goods in cash to the courier of the Delivery Service acting in the interests of the Seller. In case of receiving the Goods independently in a restaurant, the Buyer pays for the Goods upon receipt in cash or by a bank card using a payment terminal.<\/p>\n<p>5.3. Payment by the Buyer of the Order independently placed on the website means the Buyer&#039;s consent to the terms of this Agreement. The day of payment for the Order is the date of conclusion of the Purchase Agreement between the Seller and the Buyer.<\/p>\n<p>5.4. The order of payment for the Goods when ordering on the site is as follows. After you confirm your order, if you have chosen the payment method &quot;Bank card through the site&quot;, you will be redirected to the payment page of the acquiring bank, where you will need to enter your plastic card details and confirm the payment. All information you provide is confidential and not subject to disclosure. Your card details are transmitted in encrypted form. In accordance with the requirements of international payment systems, after the payment is completed, your card details are not stored either in the online store or on the Sberbank authorization server.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section data-wp-editing=\"1\"><\/section>\n<h2 class=\"section inner-bottom-xs\" data-wp-editing=\"1\"><strong>6. When ordering more than 1000 rubles, delivery within the city is free.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">6.3 When ordering less than 2500 rubles within the city, the cost of delivery will be 500 rubles.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">6.4. At the time of receipt by the Buyer from the Delivery Service of the purchased Goods, the Buyer is obliged in the presence of the Delivery Service to check the completeness and appearance of the Goods, after which the Buyer signs the shipping documents.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">6.6. If the Buyer provides false information about his contact details, the Seller is not responsible for the improper execution of the Order.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section data-wp-editing=\"1\"><\/section>\n<h2 class=\"section inner-bottom-xs\" data-wp-editing=\"1\"><strong>7. Return of Goods<\/strong><\/h2>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">7.1. Returns of prepared meals are not made.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">7.2. If the Seller delivers the Order of inadequate quality, the Buyer undertakes to provide the Goods to the Seller&#039;s office as soon as possible to check the quality of the Goods.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">7.3. In accordance with Art. 22 of the Law of the Russian Federation No. 2300-I &quot;On Protection of Consumer Rights&quot;, the amount paid by the Buyer for the Goods of inadequate quality shall be returned to the Buyer within 10 calendar days from the date of presentation of the relevant request. Refunds are made in cash at the Seller&#039;s office, in case of paid delivery, the money for it is not returned. If the Goods were paid for through the electronic payment system, then the refund is made to the Buyer&#039;s electronic account within 5 working days.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section data-wp-editing=\"1\"><\/section>\n<h2 class=\"section inner-bottom-xs\" data-wp-editing=\"1\"><strong>8. Copyright<\/strong><\/h2>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">8.1. All textual information and graphic images posted on the Internet site <a href=\"https:\/\/sakura-restaurant.ru\/en\/\">https:\/\/sakura-restaurant.ru<\/a>, are the property of the Seller and \/ or its suppliers and manufacturers of the Goods.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section data-wp-editing=\"1\"><\/section>\n<h2 class=\"section inner-bottom-xs\" data-wp-editing=\"1\"><strong>9. Rights, duties and responsibilities<\/strong><\/h2>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">9.1. The Seller is not responsible for the improper use of goods by the Buyer ordered on the website or through the Operator.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">9.2. The Seller has the right to transfer its rights and obligations for the execution of Orders to third parties.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">9.3. The Seller has the right to record telephone conversations with the Buyer. In accordance with paragraph 4 of Art. 16 of the Federal Law &quot;On Information, Information Technologies and Information Protection&quot; the Seller undertakes: to prevent attempts of unauthorized access to information and \/ or transfer of it to persons who are not directly related to the execution of Orders; timely detection and suppression of such facts. Telephone conversations are recorded in order to control the activities of the Operator and control the quality of execution of Orders.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">9.4. The ownership of the Order, as well as the risk of its accidental loss or damage, passes to the Buyer from the moment the funds are transferred to the Delivery employee.<\/section>\n<section data-wp-editing=\"1\"><\/section>\n<section class=\"section inner-bottom-xs\" data-wp-editing=\"1\">9.5. The Buyer has the right to report all claims for improper execution of the order by phone +7 (499) 254-08-05.
